EU unveils new AI Act and transparency rules

The European Union (EU) has announced that its new rules on the transparency of AI systems have now taken effect and are enforceable across the union as of August 2nd.

Under the new rules, chatbots and other interactive AI systems will have to notify users that they are dealing with AI, and not a human. Alongside this, images, videos, or audio that have been edited or created using AI will have to be labelled. This AI-generated or even AI-altered content will also have to carry machine-readable marks so it can be more easily detected. The implementation of these measures is expected to have a significant impact on the way businesses operate, particularly those that rely heavily on AI-powered systems. For instance, companies that utilize chatbots for customer service will need to ensure that their systems clearly indicate when a user is interacting with a machine, rather than a human representative.

The EU notes that the measures are intended to reduce deception and manipulation and help people make informed choices, according to the press release. The text also states that the regulations give businesses clearer obligations and a practical way to show compliance. This increased transparency is likely to lead to a greater sense of trust among consumers, who will be better equipped to make informed decisions about the products and services they use. Also included in the new rules are general-purpose AI models. Those organizations will now be required to document information, publish training data summaries, and implement copyright policies, with non-compliance of these rules subject to enforcement by national authorities. The documentation of information will involve maintaining detailed records of the data used to train AI models, as well as the methods employed to develop and test these models. This will enable authorities to track the development and deployment of AI systems, ensuring that they are used in a responsible and transparent manner.

Engadget pointed out that the new laws carry some pretty major penalties, with fines for companies ranging up to €15 million or three per cent of global annual revenue, and fines for institutions, bodies, and agencies of €750k. These penalties highlight the seriousness with which the EU is approaching the regulation of AI systems, and demonstrate a commitment to enforcing transparency and accountability in the development and deployment of these technologies.

The rules don’t include personal content like group chats, and “evidently artistic” satirical and fictional works. This exemption is likely intended to protect individual freedom of expression and creativity, while still ensuring that commercial and industrial applications of AI are subject to rigorous transparency and accountability standards. The distinction between personal and commercial uses of AI will be key in determining the scope of the regulations, and will require careful consideration by regulatory authorities.
